Child Support Texas Statutory Guidelines 

Texas has statutory guidelines, which are used to help determine the amount of child support payments paid for by the noncustodial parent.

The guidelines are as follows: 

  • 20 percent of parents net income for one child
  • 25 percent of parents net income for two children
  • 30 percent of parents net income for three children
  • 35 percent of parents net income for four children
  • 40 percent of parents net income for five children
  • At least 40 percent of the parents net income for six or more children.

It is important to understand how a parent's net income is calculated. To determine the net income, one must first look at the total gross income of the parent. Gross income is defined as income of the parent available from ALL sources of income. This includes any regular work wages, investment incomes, etc. From this number, income taxes, health insurance for the child, and union dues will be subtracted to reach the net income of the parent.

Texas parents are also obligated to provide health insurance for their children. The court can either order one parent to enroll the children onto an existing healthcare plan, or to reimburse the primary custodian for health care costs.
